As of April 30, 2018, owners of most private rental apartments – from individual owners to property managers – will be required to use the standard lease model for all new leases. If the landlord does not provide the standard lease within 21 days of the tenant`s written request, the tenant can terminate an annual or fixed-term lease 60 days in advance. As of March 1, 2021, all landlords must use the new Ontario Standard Lease for all leases entered into on or after that date. The standard lease form applies to most residential tenancies in Ontario, including detached and semi-detached houses, apartment buildings, condominiums and ancillary units (i.e., basement apartments). In order to terminate a tenancy prematurely in this case, the tenant must comply with the 60-day period no later than 30 days after the presentation of the standard lease by the landlord. In addition, tenants cannot apply for a standard lease if they sign a fixed-term lease before April 30, 2018, which is automatically renewed as a monthly lease after April 30, 2018. While the introduction of a standardized lease in 2018 resulted in an entirely new agreement, the recent revisions in March 2021 mean little change from the status quo. Tenants cannot apply for a standard lease if they signed a lease before April 30, 2018, unless they and their landlord negotiate a new lease with new terms on or after that date.
